7. Security Deposit and Responsibility for Damage
Security Deposit: Renter must provide a USD $500.00 security deposit before taking possession of the Jet Ski. This deposit is separate from the rental fee and is security for amounts properly due under this Agreement. It is not insurance and does not limit Renter's liability. After return and inspection, the Rental Company will refund or release the unused deposit balance. Any deduction must be supported by an itemized statement and documentation of the applicable damage or charges.
Damage Responsibility: Renter accepts responsibility for damage to the Jet Ski occurring during the rental while in Renter's or an authorized rider's possession or control, excluding documented pre-existing damage and normal wear and tear. In the event of such damage, Renter agrees to pay a minimum of USD $2,500.00, with the amount increasing depending on the nature and extent of the damage, up to a maximum of the full Jet Ski value disclosed in Section 2 before signing. The total damage charge, including any towing, recovery, repair, or replacement costs associated with that damage, will not exceed that disclosed full value. The Rental Company will document the damage and provide a written assessment and supporting repair estimate, invoice, or valuation. Renter also accepts responsibility for theft or total loss during the rental, up to that value.
Credit of Deposit: Any portion of the USD $500.00 deposit applied to a damage charge will be credited toward that charge, not added to it. For example, if the damage charge is USD $2,500.00 and the entire deposit is applied, the remaining balance is USD $2,000.00. Renter remains responsible for the unpaid balance, subject to the maximum stated above.
Prohibited Area Operation and Engine Overheating: Operating the Jet Ski in any area where personal watercraft operation is restricted or prohibited, or operating it in a manner that causes the engine to overheat, including running in shallow water, sand, weeds, or debris that blocks the cooling water intake, is a breach of this Agreement. Renter agrees that each such breach carries a charge of USD $500.00, which the parties agree is a reasonable estimate of the inspection, flushing, cooling-system service, downtime, and administrative costs that follow, and which are difficult to determine precisely in advance. This charge is applied against the USD $500.00 security deposit and is itemized as a violation charge on the statement provided to Renter. This charge is separate from, and in addition to, Renter's responsibility for any actual damage under this section, which remains subject to the minimum and maximum stated above. Where the Jet Ski is returned with no such breach, the deposit is refunded in full under the terms above.
Specific Acceptance: By accepting this Agreement, I acknowledge the USD $500.00 security deposit and expressly agree that damage for which I am responsible under this section carries a minimum charge of USD $2,500.00 and a maximum charge equal to the full Jet Ski value disclosed in Section 2, depending on the damage. I have reviewed that value before signing and understand that the deposit does not limit my responsibility. I further expressly agree to the USD $500.00 charge for operating in a restricted or prohibited area or for causing the engine to overheat, and I understand that this charge is applied against my deposit and does not replace my responsibility for actual damage.

8–12. Risk, Liability, and Reporting
Assumption of Risk: Renter understands and voluntarily assumes all risks associated with Jet Ski operation, including injury, drowning, property damage, paralysis, and death.
Release of Liability: Renter releases the Rental Company and its owners, employees, and agents from claims arising from the rental and use of the Jet Ski, including claims based on ordinary negligence to the fullest extent permitted by Florida law.
Indemnification: Renter agrees to defend, indemnify, and hold harmless the Rental Company from claims, damages, losses, and expenses arising from use of the Jet Ski.
Medical Authorization: Renter authorizes emergency medical treatment if necessary and accepts responsibility for all related costs.
Accident Reporting: Renter agrees to immediately report accidents, injuries, property damage, or law enforcement contact.
13–15. Governing Law, Severability, and Acknowledgment
Governing Law: This Agreement shall be governed by the laws of the State of Florida.
Severability: If any provision is unenforceable, the remaining provisions remain in effect.
Acknowledgment: By ticking the acknowledgment box and signing below, Renter acknowledges reading, understanding, and voluntarily agreeing to this entire Agreement, including the USD $500.00 security deposit and the damage responsibility terms in Section 7.
